This Terms of Use Agreement (the “Agreement”) constitutes a legally binding agreement between Tikal Go INC (“Tikal Go,” “we,” or “us”) and you, the user, concerning your use of www.tikalgo.com (the “Site”). By visiting the Site, you accept and agree to be bound by this Agreement. If you do not wish to be bound by this Agreement, please do not use the Site.
LICENSE TO USE THE SITE Tikal Go grants you a limited, non-exclusive license to access and view the content on the Site for your personal, non-commercial use. This license is personal to you and may not be assigned or sublicensed to others. You may not reproduce, redistribute, sell, create derivative works from, decompile, reverse engineer, or disassemble the Site without the express written permission of Tikal Go. You may not take any measures to interfere with or damage the Site. All rights not expressly granted by Tikal Go are reserved.
PRIVACY Tikal Go is committed to protecting your privacy. Please review our current Privacy Policy, which governs your use of the Site, to understand our privacy practices.
SUBMISSIONS You may submit inquiries or feedback to Tikal Go through the email addresses provided on the Site. Please refrain from submitting information considered proprietary and confidential. Tikal Go is not obligated to review any submitted content. By submitting ideas or feedback to Tikal Go, you grant Tikal Go a perpetual, worldwide, royalty-free right and license to use such content for any purpose.
REPRESENTATIONS AND WARRANTIES; INDEMNIFICATION You represent and warrant that you have the right and authority to enter into this Agreement without violating any laws or breaching any obligations to third parties. You agree to indemnify, defend, and hold Tikal Go and its affiliates, directors, officers, employees, and agents harmless from all third-party actions arising from your activities on the Site and asserting a violation of any term of this Agreement.
DISCLAIMERS AND LIMITATIONS ON LIABILITY Tikal Go reserves the right to modify the Site. You are responsible for accessing the Site. Tikal Go provides the Site on an “as is” and “as available” basis, and you use the Site at your own risk. Tikal Go expressly disclaims all representations or warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Tikal Go shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your use of the Site or this Agreement, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses. Tikal Go’s liability will not exceed USD $100.
Tikal Go’s performance under this Agreement is subject to existing laws and legal processes. Nothing in this Agreement limits Tikal Go’s right to comply with law enforcement, governmental, or legal requests or requirements regarding your use of the Site or information provided by you.
You agree to bring any claim or cause of action arising from or relating to your access or use of the Site within two (2) years from the date on which such claim or action arose or accrued, or the claim will be irrevocably waived.
FORWARD-LOOKING STATEMENTS Information on the Site may include “forward-looking statements” based on management’s beliefs and assumptions concerning future events. These statements are not guarantees of performance and are subject to uncertainties and factors outside of Tikal Go’s control. Tikal Go disclaims any intention or obligation to update or revise forward-looking statements.
GENERAL This Agreement is governed by the laws of the State of Florida, without regard to principles of conflicts of law.
Any action arising from this Agreement or your use of the Site must be initiated in the state or federal courts located in Miami-Dade County, Florida, and you consent to the jurisdiction of these courts. Tikal Go and you irrevocably waive the right to a trial by jury.
If any term of this Agreement is found invalid or unenforceable by a court of competent jurisdiction, that term will be severed from this Agreement. Tikal Go’s failure or delay in exercising any right under this Agreement does not waive further exercise of that right. Tikal Go’s rights and remedies under this Agreement are cumulative and not exclusive.
This Agreement is binding upon both parties and their respective successors, heirs, executors, administrators, personal representatives, and permitted assigns. You may not assign this Agreement without Tikal Go’s prior written consent. No third party has any rights under this Agreement. This Agreement may only be modified by a revised Terms of Use posted by Tikal Go on the Site or a written amendment signed by an authorized representative of Tikal Go. A revised Terms of Use will be effective as of its posting date on the Site.
This Agreement constitutes the entire understanding between Tikal Go and you concerning the subject matter herein and supersedes all prior agreements and understandings.
